AI TATTOO GENIE — Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website aitattoogenie.com and any related services, features, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who May Use the Service

You must be at least 13 years old (or higher age required by local law) to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to form a binding contract with us.

2. User Accounts

To access certain features, you may need to create an account with accurate and complete information. You are responsible for safeguarding your account credentials and for all activity under your account. If you suspect unauthorized access, you must notify us immediately at support@aitattoogenie.com.

3. User Input and Output

"User Input" means text, images, or other data you submit. "User Output" means the AI-generated tattoo designs created from your User Input. You retain ownership of your User Input and any User Output. However, given the nature of generative AI and similarity between outputs, identical or similar User Output may be generated by other users with similar inputs.

4. Content License Grant

By submitting User Input or content, you grant AI Tattoo Genie a worldwide, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, publish, and display such content solely to operate and provide the Service.

You further acknowledge you are responsible for ensuring you have rights to grant us this license.

5. Acceptable Use

You agree not to:

• Use the Service for unlawful or harmful purposes
• Submit content that violates intellectual property or privacy rights
• Generate or promote illegal, defamatory, obscene, violent, hateful, or sexually explicit content
• Attempt to disrupt or reverse-engineer the Service

We may remove any content or suspend accounts for violations of these Terms.

6. Subscription and Payments

6.1. Payment Processor: All financial transactions are processed by Paddle, our Merchant of Record. By subscribing to our services, you agree to comply with Paddle’s terms and conditions in addition to ours.

6.2. Subscription Plans: We offer Weekly, Monthly, and Yearly subscription plans. Each plan provides different levels of access to our AI tattoo generation and virtual try-on features as detailed on our Pricing Page.

6.3. Auto-Renewal: All subscriptions auto-renew automatically at the end of each billing cycle (weekly, monthly, or yearly) using the payment method on file. To avoid being charged for the next period, you must cancel your subscription before your current period expires.

6.4. Cancellation: You can cancel your subscription at any time through your account settings or by contacting our support team at support@aitattoogenie.com. Upon cancellation, you will maintain access to premium features until the end of your paid billing period. No further charges will be applied after cancellation.

6.5. Refunds: Payments for subscriptions are generally non-refundable due to the immediate costs of AI generation and server resources. However, all refund requests are subject to our Refund Policy. Please review the Refund Policy page for specific eligibility criteria and instructions on how to submit a request.

6.6. Changes to Pricing: AI Tattoo Genie reserves the right to modify pricing, features, and offerings at our sole discretion. Any price changes for existing subscriptions will be communicated to you via email at least 30 days in advance.

7. Termination

We may suspend or terminate your access to the Service with or without notice if you breach these Terms or misuse the Service. Upon termination, all licenses granted to you will end immediately.

8. Warranty Disclaimer

The Service is provided "as is" and "as available." We make no warranty that the Service will be error-free, uninterrupted, or fit for any particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, AI Tattoo Genie shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.

10. Governing Law

These Terms are governed by the laws of the applicable jurisdiction, without regard to conflict of laws principles.
